Jason Boakes

Jason has practiced in the field of Intellectual Property since 1994 working primarily in the Engineering and Electronics sectors. He has extensive professional experience in a variety of technical areas including the fields of physics, engineering and electronics with specialisations in telecommunications, wireless communication, electro-mechanical devices, medical devices, oil and gas products, automotive engineering and IC fabrication. More particularly, Jason has notable expertise in all aspects of wound management for the medical device sector, flexible riser and pipe solutions for the oil and gas industry as well as handset and radio access systems in the telecommunications industry.

Jason also has extensive experience in all aspects of patent procurement and defence worldwide, including before the UK Intellectual Property Office, European Patent Office (EPO) and in most other jurisdictions. Such experience includes the preparation and filing of Oppositions and Appeals at the EPO as well as post-grant proceedings in relation to UK patents.

In addition, Jason has developed a significant litigation support practice including providing opinions on the validity of third party patents, infringement advice and strategic advice concerning future product development. Much of Jason’s work has also been focussed on IP portfolio management including filing strategies, competitor analysis and patent landscaping. Jason has also advised extensively on mergers and acquisitions, general due diligence issues and licensing matters.

Jason has provided commercially-focussed advice for a range of clients including multi-national corporations, FTSE listed companies, universities and spin-out companies.

Prior to starting out in the patent profession, Jason studied physics at the University of Liverpool, where his post-graduate research experience focussed on the specialised fields of cryogenics, laser science and glass technology. Following university, Jason attended the College of Law in York where he studied a broad range of legal subjects.

Jason started his career as a patent attorney in a respected London based firm, where he qualified as a European Patent Attorney, Chartered Patent Attorney and European Trade Mark attorney. Jason relocated to the North of England in 2002 to become a partner in a large firm of Patent and Trade Mark Attorneys, where he was the national Head of the Engineering and Nanotechnology Groups for many years. He established Secerna LLP in May 2011.

Charlotte Watkins

Charlotte has practiced in the field of Intellectual Property since 2001 working primarily in the Life Sciences sector. She has extensive professional experience in a variety of technical areas including the fields of bio-therapeutics, (e.g. antibodies, fusion proteins, cell-based therapies, stem cells, RNAi), in vitro diagnostic products, gene sequencing, medical devices and wound therapy products.

More particularly, Charlotte has notable expertise in the areas of wound care management systems, protein therapeutics for the treatment of cardiovascular disorders and cell-based immunotherapy for the treatment of disorders such as cancer, HIV and auto-immune diseases.

Charlotte also has extensive experience in all aspects of patent procurement and defence worldwide including the drafting and filing of patent applications, prosecution of patent applications, the management of global patent portfolios and devising of IP strategies. As well as being highly experienced before the UK Intellectual Property Office and European Patent Office (EPO), Charlotte has a notable knowledge of the patent systems of many other key jurisdictions.

With regard to more contentious issues, Charlotte has drafted and filed Oppositions and Appeals at the EPO. An area of particular expertise is the provision of due diligence services such as the preparation of reports in support of funding rounds, mergers, acquisitions and licensing deals. In addition, Charlotte has prepared numerous freedom to operate, infringement and validity opinions in a number of technical fields, e.g. fusion proteins, wound therapies, therapeutic antibodies, medical devices and DNA sequencing techniques.

Charlotte has previously worked for clients including universities, both in the UK and US, spin-out companies, SMEs, direct US biotechnology companies, blue-chip pharmaceutical companies and global leaders in the medical devices field.

Prior to starting her career as a patent attorney, Charlotte studied Natural Sciences at Cambridge University, specialising in Pathology (Immunology and Microbial and Parasitic Diseases). Other subjects she studied during her time at Cambridge include virology, neuroscience, animal physiology and cell biology. Charlotte was a partner in a large firm of Patent and Trade Mark Attorneys in the UK before establishing Secerna LLP in May 2011.

Adrian Sewell

Adrian has practiced in the field of Intellectual Property since 2006 working primarily in the Engineering sector. He has professional experience in a broad range of technical disciplines including the automotive, oil & gas and renewable energy fields, and has experience working with many clients ranging from large multinational corporations to individual inventors.

Adrian advises on the patentability of inventions, and has considerable experience drafting and filing patent applications and prosecuting these in all the major jurisdictions. He has drafted and filed a number of successful third party observations at the European Patent Office as well as advising on Opposition proceedings. He has also obtained favourable validity Opinions from the UK Intellectual Property Office. Adrian has provided many ‘informal’ infringement and validity opinions regarding granted patents and registered designs and has been involved in numerous novelty and freedom-to-operate assessments.

Adrian graduated from the University of Nottingham with a BEng (hons) in Mechanical Engineering and initially entered the automotive industry as a Graduate Engineer with Daewoo Motor Company. Adrian later joined Jaguar Cars as a Senior Development Engineer specialising in Finite Element Analysis and worked on the XK and XJ projects. He achieved Chartered Engineer status during his time at Jaguar and continues to be an active Member of the IMechE. Adrian’s past industrial experience helps him to communicate with and understand inventors in their specific fields and allows him to professionally advise on both technical and commercial matters.

Adrian entered the patent profession in 2006 as a trainee patent attorney with one of the largest European Patent and Trade Mark firms. He qualified as a Chartered Patent Attorney in 2009 and as a European Patent Attorney in 2010. Adrian joined Secerna LLP as a Senior Associate in 2012.

Patent Drafting and Prosecution

The attorneys at Secerna are highly experienced in the core disciplines of drafting, filing and prosecuting patent applications in a wide range of technologies. Our attorneys have worked with multi-national corporations, large companies, SME’s and academic institutions and offer a tailored approach to securing patent protection that is selected according to the client’s wishes and commercial situation. We understand that each client is unique and will come to us with their own requirements. At every step, these requirements will be at the heart of the advice we provide.

We recognise that identifying new inventions and suitably defining them in a patent specification at the outset can ultimately be the key to strong patent rights. We therefore work closely with clients to characterise new potential inventions and determine how best to protect them. Thereafter, based on discussions with the client, we advise on suitable filing strategies, draft patent specifications and lodge these at appropriate patent offices. In addition, we establish a clear communication channel with the client to determine the ongoing scope of protection and geographical coverage sought and how best to achieve these aims to ensure that the resultant granted patents are of maximum commercial value.

Each jurisdiction has its own peculiarities and Secerna’s attorneys have the knowledge and experience to navigate any pitfalls and exploit any given opportunities. Our attorneys are well-versed in representing clients at the UK Intellectual Property Office, European Patent Office and, via trusted overseas agents, national Patent Offices around the world. Particularly, our attorneys have an intimate knowledge of filing and prosecuting patent applications under the Patent Cooperation Treaty, the European Patent Convention and many national patent laws. This includes, when necessary, representing client’s interests at hearings and other forms of oral proceedings.

Due Diligence and Litigation Support

As the value of Intellectual Property becomes ever more significant as part of any commercial transaction, it becomes ever more important that a competent and detailed due diligence exercise is carried out to identify strengths and weaknesses of an IP portfolio. Such exercises are carried out in preparation for mergers, acquisitions, funding submissions, market listings and re-financing rounds.

The attorneys at Secerna have a wealth of experience in the provision of due diligence services, including the preparation of Due Diligence Reports in all areas of Intellectual Property for all types of organisations and over a wide range of technological disciplines. The due diligence services we can provide range from straightforward ownership checks to fully comprehensive assessments of the infringement risks associated with a product range or service, validity issues associated with identified IP rights, complex transactional concerns and the identification of future IP opportunities and risks.

Due diligence may also be carried out on an ongoing basis to continually clear the way as new products and services are brought to market and as new competitors are identified. At Secerna, we are well versed in this process and can offer a tailored, commercially minded service responsive to any client requirement. Carrying out such due diligence, whether on a one off or ongoing basis, minimises risks and maximises opportunities should the prospect of litigation arise. Under such circumstances, the attorneys at Secerna can provide a full litigation support service including instructing counsel and case management.

Oppositions and Appeals

We recognise that from time to time the validity of a key patent can be of the utmost concern. Sometimes a competitor patent will represent a threat or block to progress and its revocation or amendment is necessary. In the case of a European patent, one way this can be achieved is through the use of the Opposition procedure at the European Patent Office which allows the validity of granted European patents to be challenged centrally. In preparing and filing such an Opposition, the attorneys at Secerna will first determine the commercial relevance of the patent in question, any perceived weaknesses and then advise on a suitable strategy for achieving a successful outcome.

Conversely, third parties may from time to time initiate Opposition proceedings in an attempt to revoke or amend a client’s European patent. In these circumstances, our attorneys will undertake a comprehensive analysis of the Opposition and its strengths and weaknesses and develop a strategy for defending the patent accordingly.

The attorneys at Secerna have considerable experience in both the preparation and filing of Oppositions and also the preparation and filing of submissions in response to such Oppositions, including representing clients in multi-opponent proceedings. Such preparation may include the securing of scientific evidence, preparation of expert witness statements, the development of prior art searching strategies and development of legal argumentation based on current case law. Designs

Design laws have been established around the world to protect the look and shape of a product. In the UK automatic protection may be available on the creation of any new design. However, it is advisable to take positive steps to register a design since registered rights are generally easier to enforce. We can advise on which aspects of a product may be protectable and how those identified aspects may best be represented so as to maximise protection.

We can assist in the filing of UK registered design applications, as well as registered Community Design applications which are single design registrations that cover all EU countries. Registered Community Designs are exclusive rights which protect the outward appearance of the whole or part of a product and which result from the features, such as the lines or contours, of the product itself and/or its ornamentation.

As design registrations are territorial by nature and thus design protection may be required in different countries, the attorneys at Secerna work with trusted overseas agents to secure design protection abroad. We will give expert guidance on strategy, timing and costs to ensure that the design of the product is protected in key markets.
