On May 24, 2024, World Intellectual Property Organization (WIPO) member states achieved a historic breakthrough after decades of negotiations. They adopted a ground breaking new treaty on Intellectual Property (IP), Genetic Resources, and Associated Traditional Knowledge.
This is the first WIPO treaty to address both traditional knowledge and genetic resources, and the first to specifically include Indigenous Peoples and local communities.
The treaty marks a significant step towards a more inclusive IP system. It requires patent applicants to disclose the source of genetic resources and, importantly, the Indigenous Peoples or local communities who provided any associated traditional knowledge.
This agreement is not retroactive, but applies to future discoveries and patent applications. Genetic resources include medicinal plants, agricultural crops, and specific animal breeds.
WIPO Director General Daren Tang hailed the treaty as a "carefully calibrated solution" that balances various interests. He emphasized its role in promoting a more inclusive IP system while fostering innovation.
This treaty represents a major accomplishment for WIPO and a positive step towards recognizing the valuable contributions of indigenous communities to scientific advancements.
